Directive 2008/115/EC is about common standards and procedures in Member States for returning illegal aliens from non-EU countries In an effort to fight illegal immigration, the directive selected some ‘tools’ such as the possibility to return home an unaccompanied minor; the option to send the individuals to a country of transit different from their country of origin; and finally, detaining the individuals in specific temporary facilities up to 18 months. The goal of this directive is to establish common rules in a particular field, which carries consequences in people’s lives and is a very sensitive topic in the political debate. The directive favours the principle of safety: the goal is to single out citizens from non-EU countries with illegal status almost exclusively as a source of public safety problems. As a consequence, there seems to be only one main concern: to send them out of the EU territory, without caring about the impact that this decision will have on them.
