Conditionality is a relatively new governance instrument in the European Union. After a brief historic reconstruction of the evolution of conditionality in Europe, of the types of conditionality, and of its pros and cons highlighted by scholars, the article deals with the design and implementation of conditionality within the cohesion policy, in the framework of the financial assistance granted during the Eurozone crisis, and, last, within Next Generation EU. A significant space is devoted to the analysis of the Regulation on the conditionality regime for the protection of the EU budget, of the EU case law, and its follow-up. While the contribution points to the critical and still unsolved knots of conditionality in the EU, it endorses a general appreciation for the use of this governance tool, though it highlights the need for a more rigorous analysis of its constitutional effects in the European landscape, as of today largely neglected.
