This paper deals with the protection of children’s rights under to the European Convention on Human Rights, discussing the issue of children’s rights as fundamental rights, in the perspective of the relationship between international law and domestic law. For this purpose, it analyses the case law developed by the European Court, with a special focus on protecting family life. The paper also analyses the principles of child-friendly justice adopted by the Council of Europe in November 2010, so as to highlight the close bond between cultural patterns and the role of the European Court.
