L’articolo analizza la composizione degli interessi nella disciplina degli Organismi geneticamente modificati (Ogm) in Cina e nell’Unione europea. Gli autori evidenziano i differenti obiettivi perseguiti dai legislatori in questa materia: da un lato, gli interessi commerciali e allo sviluppo economico, dall’altro la tutela della salute e la protezione dell’ambiente. Nella prima parte viene illustrato come questi interessi, teoricamente in conflitto, sono combinati dal legislatore cinese; nella seconda parte, invece, si descrive la relazione tra questi obiettivi perseguiti nel diritto dell’Ue, attraverso l’analisi della normativa e della giurisprudenza rilevanti. Nella parte finale dell’articolo, attraverso un’analisi comparatistica, sono illustrate le conclusioni della ricerca.
