1. Supreme Administrative Court (Consiglio di Stato) 17.2.2009 no. 896 - residence card and residence permit - differences between the two documents - refusal to issue either due to conviction for crimes relating to the protection of copyright - illegitimacy for erroneous equivalence of the two documents - exclusion of automatic application for long term residents even prior to the implementation of Directive 2003/109/EC - relevance of duration of residence.

Administrative Tribunal Veneto (Tribunale amministrativo regionale Veneto) 3.7.2009 no. 2104 - refusal to renew residence permit iniego rinnovo permesso di soggiorno per attesa occupazione - insufficient income and means of subsistence - omitted consideration of the spouse’s income - omitted evaluation of the effectiveness of the family ties.

Administrative Tribunal Emilia Romagna (Tribunale amministrativo regionale Emilia Romagna) 29.5.2009 no. 859 - request for work authorization for entry of a foreign citizen (decreto flussi) - denial due to alleged insufficient income - omitted consideration of the increased income after the request - illegitimacy of the denial; employer’s income capacity proportionally double the income owed to the future employee.

Administrative Tribunal Piedmont (Tribunale amministrativo regionale Piemonte) 8.2.2010 no. 981 - EC long stay permit - revocation for intervening conviction (drug related crime) - omitted consideration of criteria (length of stay, employment and social integration) established by art. 9 TU no. 286/98 as amended by d.lgs. 3/2007 in order to determine the concrete social dangerousness - illegitimacy.

5. Administrative Tribunal Umbria (Tribunale amministrativo regionale Umbria) 28.5.2009 no. 263 - EC long stay permit - request for the spouse residing in Italy for less than 5 years - denial for absence of 5 year requirement - illegitimacy; verification of the condition of the 5 year stay exclusively for the holder of the right; family member of foreigner with EC long term stay permit - difference in legal status in case of separation or divorce or loss of the right by the right holder.
