The article discusses the phenomenon of massive detention in Brazil, the country with the third largest prison population in the world and rapid growth of the deprivation of freedom rates. Starting from the historical factors of the Brazilian social structure will be illustrated the evolution of the prison institution and will analyze the factors that have affected the limitation of alternative penalties and the restriction of the rights of the accused, consequently failing to modify the punitive model that characterizes Brazil.
