Family and school boast a similar history, marked by their primacy as institutions, in front of their own members. The evolution of the legal system then followed a different path, aimed at favoring the rights of individuals, a requirement imposed by the maturing of social conscience in order, above all, to the position of the weakest subjects: children, students. The affirmation of minors as personalities with legal subjectivity calls into question the patterns of the past, favoring the enhancement of their position. However, the risks of conflict within nuclear formation remain. The paper evaluates the possibility of solving such conflicts in light of the duty of solidarity.
