The paper deals with examine social citizenship in the jurisprudence of the Court of Justice of the European Union. The study aims to understand whether social citizenship is capable of reproducing at the supranational level the rules of reciprocity and solidarity typical of national welfare systems. Indeed, the case-law of the Court of Justice wavering between opening and closing spaces of solidarity makes it difficult to access welfare benefits for European citizens who make use of free movement in the EU, especially those who are economically inactive. As a result, this jurisprudence risks forming, in the EU legal system, a logic of sharing social solidarity subordinated to the individual’s contribution to the production of economic wealth in the host Member State.
