With the ruling in hand, the Council of State dealt with the scope of application of Articles 16(1), 17(1) and 18(1) of Regulation (EU) No. 1177/2010 and, in particular, with the notion of “departure”. In order to assess the effective existence of the alleged violations of the regulation by the maritime carrier, the attention of the Council of State was therefore focused on the rationale of these regulatory provisions, to understand the scope of application of the rights that the aforementioned regulation recognizes to passengers travelling by sea.
