In the decisions examined below, the Constitutional Court states that the regional regulations are unconstitutional in the part where they provide for extensions of State concessions or other particular requirements and procedures for the release. While the Constitutional Court confirmed the violation of the principle of State exclusive competence in the subject matter, it does not intervene on the need to adopt competitive procedures for the renewal of expired concessions, as instead stated by the Supreme Court and the Council of State.
