The research proposed in the paper looks to the result of the Lisbon Treaty with reference to the legal regime of agriculture in Europe. The examination of the significant reforms, introduced before and after the Lisbon Treaty, supports the conclusion that the ri-nationalisation and ri-localisation of some levels of economic decision in the agricultural sector, is accompanied by a new relation between law and economy in common agricultural policy. Law, in the proper sense of regulatory discipline, different from mere redistribution discipline, is acquiring a growing importance in Cap. The reforms of European agricultural legislation introduced some sort of European Codes: i.d. the Code of direct support schemes (with Council Regulation No 1782/2003, and then with Council Regulation No 73/2009), the Code of rural development (with Council Regulation No 1257/1999, and then with Council Regulation No 1698/2005), the code of production and marketing of agro-food products (with Council Regulation No 1234/2007). Those European rules integrate themselves with National rules, originating an European Code of Agriculture, which is not a single code, but a common code, where needs and subjects, domestic and national, share a decisive role with European rulings and resolutions.
