This article discusses the theory of fundamental rights elaborated by Gregorio Peces-Barba Martínez, in the light of two distinct phases in his thinking, perceivable in the framework of his model of ‘normativismo corregido’ (Corrected Normativism). The author focusses his attention on Peces-Barba’s tension between natural law theory and legal positivism, and tries to identify the specific role played by the interaction between the various elements that the Spanish scholar looked at as constituent of the concept of fundamental rights
