This essay argues that questions about the nature of law are closely related to those about its functions, so that it is not possible to answer the former without answering the latter. The same applies to the individual institutions in a legal order: to illustrate this, the author considers confiscation in Italian law and in recent jurisprudence. This is followed by some methodological conclusions (atomism of questions and holism of answers) and observations about the distinction between such disciplines as the general theory of law and legal sociology, which ought to be integrated more extensively than is usually the case today.
