The aim of the paper was to identify the concept of mutual funds. They are considered as the legal instruments of risk management in agriculture which were introduced by European legislator in 2009. Although in some countries, like Italy, France and the Netherland, they have been practiced for a quiet long time on the basis of domestic regulation. Their legal nature enables a group of producers (the farmers - funds’ members) to share the production risk. The aim of the funds is to cover the loss of income by using the fund capital, which will enable farmers to receive compensation for the economic loss caused by specific events. Nowadays the EUs’ regulation implements only the framework of mutual funds. Thus Member States have to take the action and implement the proper provisions. The application of the mutual fund concept in Poland may bring both insurance benefit and certain social effects in agriculture.
