The author, after highlighting the main problematic issues emerging by the persisting financial and economic crisis, focuses particularly on the increasing involvement of the European Court of Justice and national Constitutional Courts in matters of economic and monetary politics. In this perspective, the paper aims to prove that in the framework of pluralism of jurisdictions operating in the European integration process reappear again, with rising intensity, the unsolved problems regarding the respect of competencies and of democratic principle, on the one hand, and, on the other, the effectiveness of social fundamental rights and of right to judicial protection.
