What forms will post-modern law be able to take in a liquid society? This is the question that was asked by the authors as the starting point for their thinking, stimulating a wide-ranging debate about the issue that involved sociologists of law and of labour, philosophers of law and general legal theorists who took part in an interdisciplinary discussion designed to cast some light on this thorny issue. The discussion formulated a wide variety of hypotheses that were not always convergent, although a consensus took shape around the prevalence of legal pluralism and the arrival on the global scene of a multiplicity of subjective situations that compete with the leading role of nation states. But that consensus was found to vanish when the extent of the changes taking place was taken into consideration, as some believe that the processes of mature modernity will be intensified and taken to extremes in the law in the near future, leaving the law with a function ancillary to the economy and subordinate to the force that the political system of the state or of a level above the state will be able to vest in the legal system, while others view the changes taking place as a more marked break with the past and an open door towards a law featuring renewed demands for justice: a fraternal, creative law
