This essay explores the relationship between Leopardi and law. Although Leopardi is best known as a poet and philosopher, his unwavering relationship with his own era and therefore with history made him also an astute theorist on politics, society and institutions. Laws, codes and justice as well as forms of government have an important place in Leopardi’s reflections which are contained, in particular, in Zibaldone di pensieri, written between 1817 and 1832. These legal observations were made in a defined historical period which, with the Congress of Vienna, saw the start of the Restoration and then, with the riots of 1820-1821, the resumption of the constitutional movement. The author is aware that the complexity, depth and perhaps contradictory nature of Leopardi’s thought as a whole, but more specifically on topics like the monarchy, democracy and republic, is such that it cannot be simplified or oriented in any preconceived direction. He thus reconstructs through the most salient passages of Zibaldone Leopardi’s considerations on: the absolute monarchy, the republican democratic state, Europe, the law and the legislation of the time, the status of foreigners and of the subject, gender equality. In this way he reveals, not only their outdated aspects compared to the debate of Leopardi’s time, but also their surprising modernity and ability to speak even to our contemporary society.
