Tracing the origins of the so-called "linguistic turn" in Italian philosophy of law, the author aims at establishing a connection between the analytical approach which derived from it and the more traditional historical approach, with a focus on the thought of Uberto Scarpelli. Doing so, the author proposes to set analytical conjectures within a practical context and to shed light on the political import of a linguistic analysis of law. From this vantage point, it is investigated whether the same reflections may be applied to the so-called "language of rights" in order to understand whether, both historically and from a symbolic and political perspective, the linguistic analysis of rights is meant to defend both the reasons and the historical significance of rights themselves.
Keywords: Law, language, rights, philosophy of law, legal theory, philosophy of language.
