To verify the number of victims of the human being trafficking is really hard. About millions of victims, estimated by the main international organizations’ reports, only a small number has been identified, assisted and protected. The reason of this lack of protection of victims in trafficking is the consequence of the bigger consideration gives to the illegal situation of migrants, rather than the violation of their rights. The Regulation 2011/36/EU contemplates many new guarantees. Than previously, when the concession of the permit of stay was subordinated to the collaboration of the victim in the investigations, the best interest of the child and the need of protection of workers, who want to back out from the labour exploitation, have to prevail.
Keywords: Victims, identity, violation of rights, new guarantees.
