The Constitutional framework of the Electronic Health Record. The Electronic Health Record (EHR) is a means that is intended to ensure efficiency, representative of a new form of communication and patient data management. The Improvement that the EHR can bring is unquestionable, both related to the protection of health of the individual and the community, both with reference to the organization of the health system. So that the EHR could be used, however, some aspects should be considered, whose treatment is essential in order to use it in full compliance with the order basic principles on which that file is inserted. This article is concerned, therefore, to resolve some of the most significant legal issues that revolve around the EHR, it also identified with reference to the conflicts that have recently emerged on the subject. It draws attention to the EHR Constitutional substrate and, in particular, the possible conciliation between privacy protection and health protection.
