Starting from the consideration of the multiple forms of interactions between the organizational choices of employers’ associations and the collective bargaining system, the essay focuses on the effects of the fragmentation of employers’ representation on sectoral collective bargaining. The observation of the extreme pluralism of employers’ organization and of the negative effects of voluntarism on the collective bargaining system leads the Author to reflect on the necessity of normative tools for measuring employers’ representativeness (even with the purpose of reduce the contractual chaos, deriving from some forms of separate negotiation). In the last part of the essay, the analysis on the suitable techniques of a (selective) regulation of employers’ representation inscribes itself in the context of the legal debate about the possibility of a heteronomous intervention on trade unions’ system and relates itself with the recurrent issue of the constitutional limitations of a legal intervention in trade unions’ matters.
