Assuming that constitutionalism owes its central place to rights, it is necessary to have criteria by which to analyze the reasons for the inclusion of duties in constitutions. Some of these duties bear a justificatory connection to solidarity. In this connection, challenges arise that essentially stem from this concept’s proximity to equality and from the basic need for a sense of recognition of the other. The constitutionalization of solidarity "resting on a specific philosophic-political model closer to republicanism than to liberalism" makes it possible to identify the welfare state as an optimal model.
A partir del hecho de que el constitucionalismo ha estado protagonizado por los derechos, es necesario disponer de criterios para analizar las razones de la presencia de deberes en las constituciones. Algunos de esos deberes tienen una conexión justificativa con la solidaridad. En relación con este concepto, se plantean retos, derivados, básicamente, de su proximidad con la igualdad y de la imprescindible presencia de un sentimiento de reconocimiento hacia el otro. La constitucionalización de la solidaridad, que descansa en un determinado modelo filosófico-político más cercano al republicanismo que al liberalismo, permite identificar al Estado Social como modelo óptimo.
