The article - dealing with the decision of the Italian Constitutional Court no. 59/2021 in which the Court declared unconstitutional under art. 3 Cost. art. 18, c. 7, St.lav., as amended by Law 92/2021, where it provides that the judge, when it ascertains the manifest lack of the fact un-derlying the dismissal for justified objective reason, «may also apply» (instead of «also ap-plies») the discipline of art. 18, fourth paragraph» - on the one hand, traces the critical issues relating to protections in case of unjustified dismissal put in place by both the Fornero reform and the Jobs Act and, on the other hand, stresses how the Court itself ends up, between the lines, to highlight to the future legislature a real road map to put order in the entire discipline of individual dismissals.
