During the changeover from Fascism to Republic, many boys and girls that had fought at the side of Republic of Salò were charged with collaboration with the Germans. Special assize courts and, after their suppression, special sections of ordinary assize courts, established in order to punish crimes of collaboration, progressively attenuated their rigorousness, in particular with regard to young defendants. In the context of the studies devoted to the issue of transitional justice, the essay focuses on the grounds of the judgements of the special assize court of Como in order to condemn or acquit young people charged with collaboration, thus balancing out repressive instances and aim of pacification.
Keywords: transitional justice, crime of collaboration with the Germans, special assize courts, Italian Social Republic, 1943-1947, Como.
