The author analyses the constituent debate on work as a form of 'effective participation' of workers in the political, economic and social organization of the country (Art. 3 Const.). In the light of this reconstruction, the author aims to highlight how the failure to implement art. 46 of the Constitution has changed the meaning of work as a form of economic and democratic participation. Finally, it is highlighted, on the one hand, how the collaboration of workers in the management of the company has acquired a renewed centrality in the current organization of production, marked by digital innovation, and, on the other, how a legislative intervention on the subject can no longer be postponed.
