The essay intends to focus on the key points of the rules on discharge in the recent Code of Crisis and Insolvency, without delay in describing the procedures, if not to emphasize the importance of a correct interpretation of the subjective and objective requirements that allow access to the institution, on the one hand, and the assessment of the extent of the write-off, on the other hand. All this in order to allow to correctly frame the limits that the discipline of discharge meets and that derive from the constitutional protection of the right of credit.
