Personal digital data is a remarkably valuable economic resource of informational capitalism. Therefore, in addition to protecting the ‘personality’ of data subjects, rules that govern access to personal data also provide legal models for the allocation of their economic value. Those rules generally rely on the consent of the data subject as a legal ground for the appropriation of the economic value of personal data. For this and other reasons, circulation of data is sometimes understood as reproducing contractual and market mechanisms. The author critically analyses in comparative perspective the relationship between those rules and the paradigm of contract and its underlying market rationality
