The international regulatory framework on aerospace dates to a historical era when commer-cial opportunities were not yet in sight and only states were operating in the sector, not for profit, but for international prestige. Such discipline does not seem adequate for the new commercial activities in space, such as tourism, from suborbital flights to package tours in orbiting space stations or planned facilities on the Moon. Noting that the space tourist is not necessarily the weaker party to the contract, it seems desirable to adopt a uniform legal framework, since laws adopted by single states, however with particularly important space activities, are not sufficient. It is necessary to define a common liability regime, to avoid, in this respect, competitive advantages to some companies (and, as far as the transport phase is concerned, an extension of the air transport regulation should be considered).
