The essay reconstructs the origin of the Charter from the point of view of one of the members of the «Convention» which worked it out, concentrating on the peculiar way in which it was given birth and the working of this body. In the second part of the essay, the author stresses the innovative character of the Chater, well beyond the limits originally fixed, which consists in making much more visible the fundamental rights which belong to the constitutional traditions of the member states. In particular Paciotti stresses the full codification of some new rights (environment, bioethics etc.) and the new structure of the Charter whose articles are organized around a core of six fundamental values - dignity, freedom, equality, solidarity, citizenship and justice -, while holding that the Chater should favor the process of European Union constitutionalization.
