The essay rewiews the main theories on collective autonomy inspired by two books by Gaetano Vardaro on this subject. The Author’s thesis is that collective autonomy is a form of private autonomy, but qualitatively different from the latter. Its function is to contribute to building a work organisation trough collective agreements. Its effectiveness on individual labour contracts depends on the employer’s choice to enforce collective agreements and the choice of the parties in the individual employment contract to apply the content of the collective agreement. The Author questions that the worker’s affiliation to a trade union should imply the enforcement of collective agreements, which only depends on the employer’s membership of an employers’ association. He also maintains that the collective agreements are not binding on individual employment contracts.
