This article makes use of unpublished sources from the Archives of the Index Congregation and of the contemporary press in order to reconstruct an unusual discussion, which took place in late nineteenth century Italy, between on one side the Holy See, which claimed copyright on ecclesiastical publication - including the Index Librorum Prohibitorum - and on the other some publishers who maintained their right to reprint and distribute the official texts of the Catholic Church. The issue involved well-known Italian legal experts and printers and was hotly debated. In the background lay the conflict between Church and State after the unification of Italy and the problems raised by the new Italian copyright law, often largely disregarded in this period.
