This paper summarises the principal phases that have led to the decriminalisation of homosexuality in Western countries, analysing the philosophical and legal conceptions underlying prosecution of male homosexuals and the issues in favour of decriminalisation. After an historical review of the criminalisation of homosexuality in Europe and the United States, the author focuses on the theoretical roots of decriminalisation - modern natural law, the Enlightenment and British utilitarianism - and on the contemporary debate about the relationships between homosexuality, criminal law and family law. The last paragraph contains some remarks about the question before legislators of how to guarantee the individual rights of gays and lesbians: although homosexuality is no longer a crime in Western countries, no real equality has been achieved and sexual orientation is still a cause of discrimination and violence
