Four years after the adoption of the law that acknowledges the Payment Service Directive in Italy, the article aims to study the potentials opened by the possibility to create and manage private payment systems. The article is focused on the oil sector, where the main operators already modified their organization in order to catch all potentials of the new legislation. Specific initiatives on the market highlight how payment services offered to distributors and/or final customers - as an alternative to cash - can be determinant to the creation of competitive advantage. Provision of the law is important mainly for networked companies, which aim to competition through cooperation. The payment system is an intangible asset in the economy of the network that the focal firm shares with the other participants. As an effect of the new legislation, the potential intangible assets sharable among the participants of the network are now widened to include the payment system - more than the traditional trademark and know how. The focal firm has the opportunity to increase the investments of the network in those resources which create the common identity. A need of development is highlighted referring to the legal formulas with which participations and returns to the investments shared into the network, are ruled.
