The essay investigates judgments of the Constitutional Court on austerity measures enacted to cope with the Euro-crisis with particular regard to measures affecting social rights. Conclusively the Constitutional Court did not have to assess measures as extreme as those enacted in other countries and therefore has been able to keep a prudent deference towards political discretion. Indeed this case law has underlined certain constitutional features of welfare rights which became evident also in the past, in judgments on restrictive measures designed to contain previous financial emergencies.
