This essay provides a review of Michele Marchesiello’s new book about Weber’s sociology of law, highlighting how Marchesiello dwells on the antinomy in Weber’s thinking between science and politics and the corresponding antinomy between the ethics of professionalism and the ethics of responsibility. As a retired member of the judiciary, the author wonders whether one or the other of these ethics suits the judicial profession, regardless of whether it is practised in a Common Law or in a Civil Law country, and concludes that both differ fundamentally from the judge’s professional ethics, even though the latter shares with academics the norms of impartiality, objectivity and respect for professional standards
