The European Union’s Regulation of 22 October 2014 on the statute and funding of European political parties and European political foundations brings to the attention the problem of the legal nature of the political parties. To this regard can be identified two distinct but related areas of investigation. First, the comparison between the national system of political parties, in view of the Italian legislation on the matter, with the European regulation. Secondly, the comparison between national systems of private law in the area of political participation. The essay is a first attempt to investigate in the two directions indicated, and offers a reading of the national legislation in the light of the principles of the Union and of the experiences of other European Union member countries
