The essay is inspired by a recent Corte Cassazione’s verdict which established that a collective agreement cannot forbid the use of so called "lavoro intermittente". The verdict is first exam-ined in terms of coherence with the letter of the law; then, in the light of system of devolution from law to collective bargaining; and finally the Author wonders about the relationship be-tween law and collective autonomy in the light of the most recent elaborations of the scholars.
