Legislative rules punishing maltreatment and violence within family and close relationships have frequently been addressed with an increase of the penal responsibility and a tightening of penalties. More recently, there is a greater awareness about the need for a more thorough investigation of the reasons of said matters and about the efficacy of the strengthening of the preventive legal measures in this field. The penalty itself, in fact, cannot satisfy the needs of protection required by this form of crime, which finds its opportunity to develop in personal relationships. The importance of combining traditional tools of punish-ment with a more comprehensive approach, including preventive measures, has therefore been gradually recognized. There is a dual purpose to these measures: first and foremost, to act promptly on behalf of the victim to avoid more serious offences; at the same time, to support the offender in developing a critical assessment of their behaviour so as not to be repeated, case in which it would deserve a more severe penalty. Besides legal tools characterized by a strictly punitive objective, it is paramount to obtain a wider cultural awareness of the issue and appropriate social policies, which are essential elements for a long-term and structured strategy focused on fighting domestic violence.
