Article 19 of the [French] immigration law, by differentiating access to social rights between French citizens and foreigners, has undermined the unconditional character of emergency social aid for the homeless. This obligation to come to the aid of another member of society in distress, considered as a moral equal, i.e. as an individual, expresses a certain type of solidarity, an individualist solidarity, to which the structural and moral dy¬namics of our society refer. The Constitutional Council recently censured this article, as well as several others, but only on procedural grounds.
