The decision of the Supreme Court in question offers interesting insights into the residual nature, or lack thereof, of invalidity due to bad faith in a trademark registered in the hotel industry. In particular, after reconstructing the bad faith concept, the protection aims related to it, and the conditions for its application, the residual nature of this declaration of invalidity is examined to understand whether, in certain cases (such as for the protection of a de facto trademark), it may be appropriate to declare this type of invalidity in conjunction with other grounds of invalidity of a distinctive sign.
