The essay examines the administrative law aspects of the principle of fair treatment of workers in public procurement, with particular attention to the balance between labour protection, competition, and the principle of performance (risultato). In light of the corrective decree to the Public Procurement Code (Legislative Decree No. 209/2024), the analysis highlights how the new provisions combine strengthening measures with potential weaknesses within the system of safeguards established by Legislative Decree No. 36/2023. In particular, the paper explores the proceduralization of the choice of the applicable collective bargaining agreement, the verification of the equivalence of labour protections, and the regulation of the reducibility of labour costs, which is admissible only in the presence of organizational efficiencies. In its second part, the paper examines local initiatives on minimum wage aimed at introducing mandatory wage thresholds (€9 per hour) in public contracts. Framed within the perspective of the socalled strategic use of public procurement, these experiences are assessed in terms of their compatibility with constitutional principles and with the principles of equal treatment and performance. The latter is proposed as the key parameter for balancing social objectives with administrative efficiency.
