LGBTQIA+ migrants deal with a double marginalization: they are discriminated against as refugees and as members of the LGBTQIA+ community. This complex condition can be traced back to social and cultural constructs such as race and gender, which are often used to justify forms of exclusion. Criminalization in countries of origin, the burden of proving persecution to obtain refugee status, and ostracism in countries of arrival ‒ even from members of their diasporic communities ‒ compose a deeply troubling scenario. The aim of this sociological investigation based on direct testimonies from reception workers and those who receive protection, is to highlight how beyond the principles enshrined in law, the effective protection of asylum rights on SOGIESC grounds remains an ongoing challenge that raises significant concerns regarding the adequacy of legal frameworks and emphasizes the necessity for institutions to respond effectively and compassionately to the legitimate needs of individuals.
