The French social landscape has undergone major changes, including the rise of collective bargaining as a producer of social norms and the possibility of derogatory agreements which may prove unfavourable to employees. These factors have sparked debates on the legitimacy of trade unions and employers organizations, signatories to collective labour bargaining and agreements and, consequently, questioning the mechanisms for recognizing their representativeness. The representativeness of employee organizations was the subject of a law in 2008. The implementation of a new measure of employers representativeness, which is currently under way, has proved to be more complex and tumultuous.
