The paper analyzes the legal history of the introduction of commercial firm and agricultural firm in Italian civil code of 1942 and of bankruptcy law after the death of commercial code of 1882. The recent statute laws raise the overtaking of legal structure of codification of 1942 due to the actual development of agricultural firms in the latest decades and to radical change of purpose of bankruptcy law. In the background, however, it remains to review the legal distinction between big and small enterprises.
