Legal Orders with an Oral Tradition in Sardinia: The Case of the Rasgioni in Gallura ABSTRACT: The customary law of Sardinia’s traditional communities offers a panorama of considerable interest in the area of the anthropological and legal research of systems of conflict solving. After a brief description of the fieldwork conducted (in the central Sardinian area of Barbagia) in relation to this topic, this essay examines a different cultural area (the northern region of Gallura), which is also of specific ethnographic interest. Attention is focused in particular on one local institution in Gallura (known as rasgioni), which was passed on by word of mouth and only fell into abeyance some thirty years ago, as a previously unpublished record of it has been discovered: an audio recording made in November 1963 in the village of Giuncana (in the countryside between Bortigiadas and Viddalba). A study of this traditional institution also enables an analysis to be made of the profiles of legal acculturation that emerge in the relationship between the spontaneous legal order adopted by the local communities in Gallura and the official, refined legal order of the state. Lastly, the article throws light on the analogies and the differences observable between the systems of peaceful conflict solving identified in the two cultural areas of Sardinia (Gallura and Barbagia), identifying the basic topics to be used for a future comparative survey.
