The agricultural market is currently facing a difficult and growing phase of instability worldwide. This could make clearer the non-opportunity as well as the non-applicability of the liberalism in the primary production. Indeed, it is not a secret within the agricultural world that free market and rules of competition do not produce those positive effects capable to cope with the disadvantages pertaining to the peculiar characteristics of the sector. Besides, by fixing goals such as the security of supplies, an adequate income for farmers and reasonable prices for consumers, art. 39 of the Treaty - which has not been modified since the old Treaty - stipulates that competition rules may not be applied to production and trade of products within Annex I. However, the ongoing Cap reform (Communication of the Commission, 18 November 2010, "The Cap towards 2020: Meeting the Food, Natural Resources and Territorial Challenges of the Future") tends keeping its position which has created a difficult period for the agricultural market and related income since the reform of 2003 and the introduction of the decoupling. The Communication does not put forward proposals consistent with the Commission’s intention to guarantee food security and the relation between environment and climate change, detected as challenges for the agricultural world. Furthermore, the Communication seems privileging measures aiming at abandoning the support to the income as well as to the market instruments. On the contrary and considering the recent north African developments, it would be advisable to stimulate agricultural and food production, increasing stocks and boosting food supplies for food security.
