In terms of sociology of law, in the classical Weberian pages, the rationalization of legal knowledge takes place in Rome. But, in a typological sense, the legal dispute is founded in the Greek culture and especially in the colonies, from Caronda to Gorgias. Greek culture was a major producer and consumer of judicial notice: the public debate was defining element of the liberty of the ancients. The culture of the legal dispute and of the dialectical confrontation merges with the practice of democracy. In litigation communication the conflict on the rules of the game can be resolved peacefully and rationally. And this is, perhaps, the most valuable teaching and more and more relevant legacy that the rhetoric of yesterday has passed to the jurists of today.
