In this paper the author traces the history of regulations and legal provisions on worker and retiree status. Until the nineties, the condition of incompatibility between the two statuses prevailed, despite wide exceptions and contradictions. Such regulations (provisions), however, produced unexpected consequences such as labour supply for undeclared work. In the following years, a progressive and almost complete liberalization prevailed in the changed legislation. The most recent laws which have increased the retirement age have led to a new context and issues. As a result, the possible links between retirement and working condition need to be rethought.
