The article, which is based on a conference paper given at the University of Bologna on the 70th anniversary of the entry into force of the Italian Constitution, analyses the role and regulation of trade unions by considering the articles which most shape their identity under the Constitution, namely articles 39, 40 and 46. Particular attention is given to the positions expressed by the Constituent Assembly, though, of course, I also discuss the post-constitutional period, the reasons for the non-application of part two of article 39, the over-application of paragraph one of the same article, the characteristics of ordinary trade-union legislation, as well as the current, extremely lively debate on whether and how it should be reformed.
