The contribution examines state-owned maritime assets, together with their duration and the risk transfer, according to the Bolkestein Directive and the judgment of the European Court of Justice of 14.7.2016. The Council of State’s Plenary Assembly judgments no. 17 and 18 of 2021 appear to have put an end to the concessions’ renewals. The conclusions will take account of the new Competition Bill, which could introduce a uniform regulation of state-owned maritime concessions.
